Canada’s New Asylum Process Starts Today: What You Need to Know

Canada’s asylum system is changing, and the first piece takes effect today.

What changed today (November 3, 2026)

IRCC has changed how refugee claims are submitted online through the IRCC Portal, as part of a much larger overhaul of the asylum system. Claims submitted through the portal by 11:59 p.m. Eastern on November 2 will generally not need the new information, unless IRCC asks for it. People with unfinished applications will need to review what they already entered and answer the new or unanswered questions.

That cutoff was not a deadline for making an asylum claim in Canada. It only marked when the old online form was retired. If you have been putting off your claim, don’t panic, but don’t wait either.

The bigger change: who can claim

The portal update sits alongside Bill C-12, which became law in March 2026. People who arrived in Canada after June 24, 2020 can no longer make an asylum claim more than one year after they first arrived. This rule applies to claims made on or after June 3, 2025. There are exceptions, including for unaccompanied minors and certain early-registered applicants.

What this means for you

  • Timing matters more than ever. The date you arrived and the date you claim can decide whether your claim is even heard.
  • Details matter. The system is built to move only complete, well-prepared files forward, so gaps and inconsistencies can hurt.
  • Backlogs are real. The Immigration and Refugee Board has nearly 300,000 pending cases, with waits averaging about 25 months. The government wants faster decisions, and that is a fair goal.

A little perspective

Nobody disputes that a backlog this size is a problem. But critics worry the new eligibility rules could leave some vulnerable people without a full refugee hearing. Speed and fairness have to travel together. For people who have already lived through the worst, a missed date shouldn’t be the end of the story, and that is why getting good advice early is so important.
