Personal Injury

Underinsured Motorist Protection

April 16, 2015 by FH&P Lawyers

In my last blog, I wrote about how a BC motorist is only obligated, as part of the process of licensing and insuring his or her vehicle, to purchase Basic Autoplan Insurance. Basic Autoplan Insurance provides only $200,000.00 in Third-Party Liability Insurance. That is not very much money if a person is seriously injured, or there are claims made by multiple people such as passengers. The low amount of mandatory Third-Party Liability Insurance can be a problem if you are the one injured.

If you are seriously injured and your claim (or the aggregate of all of the claims made against the responsible driver) exceeds $200,000.00, you must look to the assets of the motorist. Unfortunately, many motorists who choose basic coverage do so because they cannot afford optional, extended Third-Party Liability Coverage. Such a person has no assets to satisfy your claim. Fortunately, if you purchase insurance for your vehicle in BC you are covered for Underinsured Motorist Protection. That coverage provides up to $1,000,000.00 per person, if the at fault driver did not purchase enough insurance to satisfy your claim and does not have the assets to pay it. The insurance you purchase also covers members of your household. In fact, for $25.00 per year, you can purchase optional Underinsured Motorist Protection which provides $2,000,000.00 of coverage. That, in my opinion, is a good deal.
