Arbitration Overhaul

The first major overhaul to commercial arbitration since 1986 occurred in 2020 when the new Arbitration Act replaced the older version and was modelled mainly off of the Uniform Model Arbitration Act.

Class Action Waiver Clause

The 2017 BC Court of Appeal decision in the matter of Pearce v. 4 Pillars Consulting Group Inc. Found a class action waiver clause unenforceable and contrary to public policy as it would prevent members from pursuing any claims due to the small amount.
