ENVIRONMENTAL LEGAL HELP ROOTED IN THE OKANAGAN.

FH&P's environmental law practice covers the full range of issues that arise in communities like ours. We represent First Nations, non-profits, farmers, business owners, and individuals. We also help clients who are concerned they may not be in compliance with provincial law and want to understand their obligations before a problem grows.

Environmental issues do not always start in a courtroom. When something looks wrong, the instinct is often to speak out publicly first and ask legal questions later. That approach can backfire. Getting advice early protects your ability to act effectively and avoids the risk of a defamation claim or similar lawsuit against you.

What We Help With

Pollution and Contamination Disputes: Chemical spills, agricultural runoff into waterways, and pollution of drinking water sources all require fast, precise action.

Smoke and Air Quality Disputes: Open burns, industrial smoke, and neighbour disputes involving interference with land use are increasingly common across the Okanagan.

Waterway and Shoreline Issues: Non-compliant structures on lakeshores, water flow interference, and disputes involving irrigation and water rights.

Hunting, Fishing, and Land Use Rights: Rights-based disputes involving agricultural land, hunting and fishing laws, and land-use obligations are a regular part of environmental practice in the Okanagan.

Regulatory Compliance: If you are a farmer, business owner, or land developer who is unsure about your obligations under provincial environmental legislation, we can help you understand the rules and get ahead of potential issues before they become costly.

Advocacy and Bylaw Navigation: Not every environmental issue requires litigation. We also assist clients with bylaw complaints, town hall submissions, and regulatory processes, helping you navigate the right channel for the outcome you are looking for.

Why FH&P? We Know This Region. We Work Both Sides.

FH&P is here. Our lawyers understand the land-use, agricultural, and water issues specific to this region, and we represent clients on both sides of an environmental matter. Whether you are bringing a claim against a polluter, responding to a compliance concern, or simply trying to understand your obligations, we can help.

As a full-service firm, we are also equipped to handle the legal issues that often accompany environmental disputes, including defamation, breach of contract, and dealings with regional districts and provincial regulators.

If You Think Something Is Wrong, Read This First

  1. It does not have to be about suing someone. If you believe an environmental harm has occurred or is occurring, there is likely an avenue for a remedy that does not involve litigation. Start with a conversation.
  2. Earlier is better. Cleaning up an environmental issue is far harder than preventing or addressing it early. The sooner you act, the more likely you are to protect what matters.
  3. If you may be in breach, getting ahead of it saves money. If you think you or your business might not be in compliance with provincial environmental law, addressing it proactively will cost significantly less than responding to a fine or enforcement action.

Not Sure Where to Start? That Is What We Are Here For.

Environmental law in BC covers a wide range of situations, and many people do not know what their options are until they ask. A conversation with one of our lawyers could protect something that cannot be replaced.
