Sports Law is a specialized field that combines elements of both law and sports, focusing on the legal issues that arise in the world of athletics, from amateur to professional levels. Sports law governs the relationships between athletes, teams, leagues, sponsors, and governing bodies, addressing issues such as contract negotiations, endorsement deals, doping regulations, and issues of discrimination or injury.

FH&P Lawyer Brett McClelland is a litigator experienced in Sports Law and can assist with the following areas related to this practice within the more traditional court based civil litigation system:

  • contractual disputes including breach of contracts of employment and breaches of sponsorship agreements; and
  • personal injury claims in relation to recreational participants, competitive athletes, spectators, volunteers, employees, and coaches.

Alongside the traditional court-based litigation system, Brett McClelland represents clients in sporting-specific tribunals such as the Sport Dispute Resolution Centre of Canada and the Office of the Sport Integrity Commissioner Issues within the purview of the Sport Dispute Resolution Centre of Canada include:

  • Team Selection Disputes
  • provincial sport organization team selections
  • national sport organization team selections
  • major competition team selections
  • Carding Disputes
  • Doping Disputes

The Office of the Sport Integrity Commissioner (OSIC) administers issues related to the Universal Code of Conduct to Prevent and Address Maltreatment in Sport (UCCMS) through the Abuse-Free Sport system. In April 2024 OSIC created the Abuse-Free Sport Legal Aid Program and invited Brett McClelland join the program representing both claimants and respondents across Western and Northern Canada.
