Estate Disputes Are on the Rise

With rising home values and changing family dynamics, estate litigation is becoming more common across British Columbia. FH&P Lawyers is seeing a sharp increase in disputes—often involving multiple properties, outdated wills, and siblings with very different ideas of what’s fair.

“You’re no longer dealing with a $200,000 home,” says Darren Kautz, FH&P Partner and head of litigation. “You’re dealing with a $2 million home—and that’s where disputes start.”

In a recent Law Talk Podcast, the firm explored Lam v. Law Estate, a BC Supreme Court case where a daughter challenged a seemingly equal will. The court found systemic favouritism toward the son and ruled in the daughter’s favour. “Cultural norms don’t hold water before our courts,” said Partner Tanvir Gill.

The takeaway? A basic will isn’t enough. Kautz urges families to plan early, involve legal and financial professionals, and avoid shortcuts like joint accounts that often lead to court.
